An individual cannot place the CCTV wherever he wants. There are some laws that person have to follow for using CCTV. However, CCTV is very helpful in the modern era. What are the laws made by government to use CCTV camera ?
You must know that CCTV is considered as the best evidence by Supreme Court. CCTV footage helps you in many ways ,like when any thief enters your home and he tries to steal something from your home then this all can be catch in your CCTV at an accurate time.
CCTV Laws :
1. If you are a shopkeeper, then you cannot place camera in the toilets and changing room. If you did so,then you are doing a crime according to IT Act Section 66e, whoever,captures or transmits the image of a person without his/her permission ,shall be punishable and would be put into the jail for 3 years or he have to pay a fine of 2 lakh rupees.
2. Secondly,you are not allowed to use camera at a place where the privacy of women is prohibited. You can be punished according to Act IPC Section 354.
3. If you are having a Hotel,then do not place cameras in hotel rooms or toilet areas. You can use it at a reception area ,lobby or at the front of hotel. Mark the disclaimer that you are in front of CCTV camera. So that people cannot do private things .
Right to privacy is a right available for all Indians. So you can not place the front of camera .If you capture the information about the happenings going on in others home,then this is considered as a crime according to IT Act Section 66e. However, you can use CCTV for your own protection or you can use it at your business place.
